3. P&Z Applications

a) GEX, ETHEL (ESTATE OF) – application for Proposed Amendment to the Zoning Ordinance. The applicant is requesting a change in the zoning on the above mentioned parcel of land that is currently zoned R-5, Open Beach District to be rezoned to C-2, Commercial Neighborhood District. The reason for this amendment is there is a change or changing conditions in a particular area, or in the city, or in the regional area generally, in which an amendment to the Ordinance is in the public interest and is necessary and is desirable. If the amendment for a C-2, Commercial Neighborhood District is granted, the applicant will need a variance to the required 10,000 sf minimum lot area. The proposed lot area is 8,256 sf. The total variance needed to the minimum lot area is 1,744 sf. The applicant is also asking for a variance to Article VII, Chart 2, Area, Yard and Height Requirements for a C-2, Neighborhood Commercial District. The applicant is asking to implement Article VII, Chart 2, Area, Yard and Height Requirements for a C-1, Central Business District. The property is located on the East side of South Beach Boulevard and is adjacent to 210 South Beach Boulevard, Parcel #149L-0-29-110.000, described as Lots 176 and 179, 2nd 5, Open Beach District. P&Z did not recommend approval by vote 3-3 – one member did not vote.

b) MIKE JOHNSON – application for Variance to the Zoning Ordinance. Representing agent is Mr. Thomas Lewis. The applicant’s intention is to construct a deck to the rear of the residence. The applicant is asking for a 10’ setback to the rear yard, therefore the applicant is asking for a 10’ variance to the rear yard setback. The property is located at 530 State St., Parcel #149E-0-29-247.005, described as Part 472, 1st Hancock County, Mississippi. The property in question is zoned R-3, Multi-Family District which requires a 25 foot front yard, 8 foot side yard and 20 foot rear yard. P&Z recommended approval 6-0.

c) MARK AND MARGIE CHEEK- application for Variance to the Zoning Ordinance. The applicants’ intentions are to construct a cargo lift to the side of the residence. The applicant is asking for a 5.5’ ft. variance to the side yard which requires an 8’ side yard, therefore the applicant is asking for a 2.5’ ft. setback to the side yard. The property is located at 93 Harrison Rd., parcel #136L-0-37-082.000, described as Lot 37, Block A, Jourdan River Isles, Bay St. Louis, Hancock County, Mississippi. The property lies in an R-1; Single-Family District
which requires an 8’ side yard for a single family structure. P&Z recommended approval 6-0.

d) DEXTER HART – application for Special Exception to the Zoning Ordinance. The applicant is asking for a Special Exception to the Zoning Ordinance to allow the use of a sports bar. Parcel #149M-2-30-169.000, described as Part 36 &37, All 38 &39, Ballentine Subdivision, Bay St. Louis, Hancock County, Mississippi. The property is located at 211 Central Avenue and the corner of Ballentine Street. The property is zoned C-2, Commercial Neighbor District. According to Section 621, CHART OF USES FOR ALL ZONING DISTRICTS, “Bars, Taverns, Nightclubs & Lounges” may be allowed in a C-2 District by Special Exception. P&Z recommended denial 6-0.

e) JAMES P. AYCOX, JR. – application for Special Exception to the Zoning Ordinance. The applicant is asking for a special exception to zoning ordinance to construct an accessory structure without a primary structure in place. The intention is to build a 39’ x 14’ deck on top of the existing pilings that are located on the property. If the special exception is granted, it will need to be proven that the pilings in place are structurally sound. The property in question is located at 11289 Texas St., parcel #134J-0-40-080.002, described as Lot 25, Square 338, Unit 3, Addition 1, Shoreline Park Subdivisions, Bay St. Louis, Hancock County, Mississippi. The property is currently zoned R-1A, Single-Family District. P&Z recommended denial 6-0.

f) NINA J. CARVER, JENNIFER J. CARVER & HAROLD CARVER– application for a Special
Subdivision. The applicants’ would like to subdivide the three (3) existing parcels of land into eight (8) new parcels of land. The new parcels of land will meet all requirements for Area, Yard, and Height as set forth in a C-1 District. Parcel #149F-0-29-316.000 is described as Lot 528, 1st described Lot 529, 530, 531A, Part 483, Parcel #149L-0-29-067.000, Lot 26, 2nd County, Mississippi, The properties are located at 200, 201, 206, 207, 209, 211 and 213 Main St. The properties lie in a C-1, Central Business District. P&Z recommended approval 6-0.

g) THE CITY OF BAY ST. LOUIS is requesting the following text amendment to the Zoning Ordinance. The reason for the amendment is there is a change in conditions and it is in the public interest and is necessary to facilitate accuracy and proper interpretation. The proposed amendment does not involve changing the classification of land. 302.123 RECREATIONAL VEHICLE: A vehicular type Ward, Bay St. Louis, Hancock County, Mississippi. The property lies in an R-unit primarily designed as temporary living quarters for recreation, camping, or travel use, which either has its own motor power or is mounted on or drawn by another vehicle. Examples include travel trailers, camping trailers and motor homes. No recreational vehicle shall be used as a dwelling. Recreational vehicles shall only be allowed for recreation and camping in a designated Recreational Vehicle Park. A recreational vehicle is only allowed to
be stored on a parcel of land where there is a primary dwelling present. P&Z recommended approval 5-0.
