Planning & Zoning Applications
JUL DEDEAUX – Application for Special Exception to the Zoning Ordinance.  The applicant is asking for a special exception to the zoning ordinance to allow a golf cart rental business at this location.  The property in question is located at 442 Main St., at the corner of Main St. and St. Francis St., Parcel #149E-0-29-305.000, described as Second Ward, Lot 53,54 & 67, Bay St. Louis, Hancock County, Mississippi. The property is zoned C-2, Neighborhood Commercial District.  On June 2, 2015, the Bay St. Louis City Council approved the request for a text amendment to the Zoning Ordinance to allow by Special Exception Golf Cart Sales, Rental& Repair Service business. P&Z recommended approval 4-1 (Jordan recused) with the stipulation that a golf cart is not allowed to leave rental property without being on a trailer by the owner or renter. Also, the owner must have liability insurance and check to see if the renter has insurance.

BILLY RAY SANDERS & ELIZABETH VEGLIA – Application requesting a Text Amendment to the Zoning Ordinance. The reason for the amendment is there are changing conditions in a particular area, or in the city, or in the regional area generally, in which an amendment to the Ordinance is in the public interest and is necessary and desirable.  The proposed amendment does not involve changing the classification of land and is necessary to facilitate accuracy and proper interpretation.  The applicants are asking to amend the Chart of Uses to allow the use of “Bait Shop” to be allowed in a C-2, Commercial Neighborhood District by Special Exception.  P&Z recommended approval 6-0 to amend Chart of Uses to allow use of a bait shop.

BILLY RAY SANDERS & ELIZABETH VEGLIA – Application for Special Exception to the Zoning Ordinance. Should the text amendment to the Chart of Uses for a “Bait Shop” in a C-2 District be approved, the applicants are asking for a Special Exception so that they may be allowed to conduct a bait shop business at this location. The property in question is located at 265 Washington St., Parcel #149M-2-30-114.000, described as Lot 316, D&E, Third Ward, Bay St. Louis, Hancock County, Mississippi. The property lies in a C-2, Neighborhood Commercial District. P&Z recommended approval 6-0.

BARBARA AMBROSE – Application for a Special Exception to the Zoning Ordinance. The applicant is asking to allow a women’s community support center to be conducted at this location. The center will be used for housing adult women. This use would fit the category as described in Section 621: CHART OF USES FOR ALL ZONING DISTRICTS, as an assisted living facility which is allowed by Special Exception. The property is located at 1250 Old Spanish Trail. Parcel #137P-1-35-022.001, described as Bay St. Louis Land & Improvement Company, 1st Addition, Bay St. Louis, Hancock County, Mississippi. The property in question is zoned C-2 Neighborhood Commercial District.  Application Withdrawn by Applicant.

ALAN & ROBIN COPELAND – Application for Special Subdivision Plat Approval and Variance to the Zoning Ordinance. The applicants are asking to separate this parcel of land into two new parcels of land. The present parcel of land currently has a business located on the property.  The applicants’ intentions are to construct a single family residence on the newly created parcel. The newly created parcel will need a variance of 4’ to the minimum lot width for a proposed 21’. The new parcel will also need a 17’ variance to the front yard, for an 8’ setback to the front yard where a 25’ setback is required.  The new parcel will also need an 11’5” variance to the rear yard, for an 8’7” setback to the rear yard where a 20’ setback is required. The new parcel will need an 8’ variance to the east side yard for a 0’ setback to the east side yard where 8’ setback is required. The new parcel will need a 5’ variance to the west side yard for a 3’ setback where 8’ setback is required.  The property is located at 107 Court Street, Parcel #149L-0-29-102.000, described as Lot 3 and the East ½ of lot 4, Block 1, Hotel Company’s Subdivision, Bay St. Louis, Hancock County, Mississippi. The property is currently zoned C-1, Central Business District. P&Z recommended approval 6-0.

JIM & JANICE HALL – Application for Variance to the Zoning Ordinance.  The applicants are asking to construct a detached carport with an upper level which will be used for storage. The yard setbacks for an accessory structure are a minimum 25’ front yard, 5’ side yard and 5’ rear yard. The applicants will need 8.5’ variances to front for a 16.5’ setback to the front yard and a 4’ variance to the side yard for a 1’ setback to the side yard for the accessory structure. The property is located at 200 St. George St..  Parcel #149F-0-29-204.000, described as 1st Ward, Lot 397, East 1/2,  Bay St. Louis, Hancock County, Mississippi. The property is currently zoned R-3, Multi Family District. P&Z recommended approval 6-0, with the stipulation to have gutters for water to run off away from neighbor’s property.

DAVID M. & MARY ANN BENVENUTTI – Application for a Variance to the Zoning Ordinance.  The applicants are asking to install a 6’ tall wood fence on the property line that fronts St. Charles Street where a 4’ fence is allowed. The applicants are asking for a 2’ variance to the fence regulation to allow a 6’ high fence to the front of the property where the maximum fence height is 4’. The property in question is located at 434 Pecan Park Drive and extends to St. Charles Street.  Parcel #137J-0-44-337.000, described as Pecan Park, Lot 42, Bay St. Louis, Hancock County, Mississippi. The property is zoned R-1, Single Family District which requires a minimum 25’ front yard setback. P&Z recommended approval 6-0, with the stipulation that fence should set back with neighbors and match up with neighbor’s fence.

CLIFF KENWOOD, & MICHAEL & URSULA MCCLURE – Application for Special Subdivision Plat Approval and Variance to the Zoning Ordinance. The applicants would like to change the configuration of two parcels of land into two new parcels of land. The newly created parcel of land fronting on South Beach Boulevard will meet the requirements according to the zoning ordinance for an R-4 District. However, the parcel of land fronting on Sycamore St. will need 6,081 sq. ft. variance to the minimum lot area which requires 12,000 sq. ft. The property which is located at 418 South Beach Boulevard lies in an R-4, Residential Beach Front District Parcel #149L-0-30-212.000, described as Part Lot 140, 3rd Ward. The property which is  located at 113 Sycamore Street lies in an R-1, Single Family District, Parcel #149L-0-30-222.000, described as, 3rd Ward, Lot 143D, 146 and 143E, Bay St. Louis, Hancock County, Mississippi. Application Withdrawn by Applicant.

STEVE HATHORN – Application for Subdivision Plat Approval and Variance to the Zoning Ordinance.  The applicant would like to subdivide this parcel of land into 2 new parcels of land identified as Lot 30 and Lot 31.  Lot 30 will need a 5,999.88 sq. ft. variance to the minimum lot area for the proposed 6,000.12 sq. ft. to the minimum lot area. Lot 30 will also need a variance of 39.93’ to the minimum lot width for a proposed 60.07’ lot width. Lot 31 will need a 6,037.80 sq. ft. variance to the minimum lot area for the proposed 5,962.20 sq. ft. minimum lot area. Lot 31 will also need a variance of 39.17’ to the minimum lot width for a proposed 60.83’ lot width. The property in question is located at 114 Edith Dr., Parcel #135R-0-47-069.000, Lot 30 & 31, Block 3, Jourdan River Estates Subdivision, Bay St. Louis, Hancock County, Mississippi. The property is zoned R-1, Single Family District which requires a 100’ minimum lot width and 12,000 sq. ft. minimum lot area. P&Z recommended approval 6-0.

HANCOCK BOARD OF SUPERVISORS – application for Special Subdivision Plat Approval and Variance to the Zoning Ordinance. The applicant would like to subdivide this parcel of land into 2 new parcels of land. The newly created parcel of land identified on the official survey as Parcel A, will remain in its current use as a public boat launch. Parcel A will need a 48.7817 acres variance to minimum lot area. The property in question is known as the Cedar Point Boat Launch located at 711 Hollywood Drive., Parcel #136K-0-38-002.002, Lot 1, 22, 25, 26, 27, 28, 29, West of Engman, North Avenue, Lots 71, 73, 74, 75, 76,  Rear 1st Ward, Bay St. Louis, Hancock County, Mississippi. The property currently lies in two zoning districts; CD-Casino District and RD-Resort District. In a CD District and a RD District, the minimum lot area is 50 Acres. P&Z recommended approval 6-0.

CITY OF BAY ST LOUIS – Requests a public hearing for public comment and the recommendation of the Planning and Zoning Commission for the Ordinance for short term vacation rental properties. TABLED 3-0  (Jordan and Manieri recused)

GARY KNOBLOCK – Application for Variance to the Zoning Ordinance.  The applicant is asking for a variance to the fence regulation to allow a 6’ in height fence to the front of the property where the maximum fence height is 4’. Therefore, the applicant is asking for a 2’ variance to the fence height. The property in question is located at 2020 Hugo St., Parcel #137M-1-35-033.001, described as Lots 9-11, Part 12, Block 120, Bay St. Louis Land and Improvement, Bay St. Louis, Hancock County, Mississippi. The property is zoned C-3, Highway Commercial District, which requires a minimum 25’ front yard setback. P&Z recommended approval 6-0.
